The court approved a settlement agreement in a case concerning the division of marital property
The team at the “Ester Guardians” Law Firm successfully concluded its representation in a complex case regarding the division of marital property (Case No. 362/1410/25), which resulted in the parties reaching a compromise and the court approving the settlement agreement.
On May 4, 2026, the Vasylkiv City and District Court of Kyiv Oblast approved the settlement agreement reached by the parties during the proceedings regarding the division of property acquired during the marriage and closed the case.
The subject of the dispute was the division of a significant amount of the spouses’ joint property, including a residential house, land plots, and an apartment, as well as the settlement of mutual property claims between the former spouses.
During the court proceedings, the parties managed to reach a mutual understanding and develop a property division mechanism that fully met their interests and allowed them to finally settle the dispute without the need for further court proceedings or a decision on the merits.
As a result of the settlement agreement, issues regarding the ownership of real estate, the distribution of property rights, and the parties’ mutual financial obligations were resolved. The court concluded that the terms of the settlement agreement did not conflict with legal requirements, did not violate the rights of third parties, and reflected the genuine intentions of the parties.
It is particularly important that all of our client’s key interests were taken into account and fully addressed, which made it possible to achieve the desired outcome without wasting additional time and resources on a lengthy court proceeding.
This case demonstrates once again that a settlement agreement is not only a procedural tool for resolving a legal dispute but also an effective way to protect the parties’ interests. With proper legal guidance, the parties can reach a balanced solution even in complex property disputes, retaining control over the outcome of the dispute rather than leaving the final decision solely to the court’s discretion.
At our law firm, we are convinced that a successful outcome is not only a favorable court ruling but also any legal settlement that best serves the client’s interests. That is why, in every case, we evaluate all possible avenues for protecting our clients’ rights and select the mechanism that allows us to achieve the most effective result.
