The ESTER GUARDIANS Law Firm team successfully completed comprehensive legal representation of a client in a complex dispute over the division of marital property, achieving a favorable outcome both during the court proceedings and at the stage of enforcing the court’s decision.
The case began with a lawsuit filed by the client’s ex-husband seeking the division of marital property, in which he asserted property claims totaling approximately 850,000 UAH. At the time the client retained our law firm, the parties were in a state of acute conflict and were effectively not communicating at all.
After a detailed analysis of the case circumstances, the ESTER GUARDIANS team formulated a strategy of active defense and filed a counterclaim, in which, among other things, it asserted the following claims:
division of the apartment, ownership of which was registered in the ex-husband’s name;
the recovery of 600,000 thousand UAH in favor of the client by taking into account, during the division of property, a vehicle that was registered to the husband and sold by him on the eve of the dispute—an action that appeared to be an attempt to conceal an asset prior to the upcoming division.

As a result of the case proceedings, we were able to achieve substantial protection of the client’s property rights. The court’s decision ensured:
recognition of the client’s ownership of a 1/2 share of the apartment;
a substantial reduction in the client’s financial losses from 850,000 UAH to 150,000 UAH;
adequate protection of the client’s interests during the division of the couple’s joint property.
After the judgment became final, the ESTER GUARDIANS team did not limit itself to legal representation but continued to assist the client during the enforcement phase.
Thanks to negotiations between the parties, an agreement was reached regarding the voluntary enforcement of the court judgment. Enforcement was carried out by offsetting reciprocal claims of the same nature, followed by payment of the remaining amount due.
This approach allowed the client to avoid the initiation of enforcement proceedings, avoid additional costs associated with compulsory enforcement, and significantly reduce the time required for the actual enforcement of the court decision.
This case illustrates that effective legal protection consists not only in obtaining a favorable court ruling but also in ensuring its actual and cost-effective enforcement. What began as a conflict in which the parties were unable to engage in dialogue evolved into constructive negotiations and a final, legally sound resolution of the dispute.
